PlanTrackAnalyze Terms and Conditions
DRSOLID LLC
Effective date: 16 October 2026
These Terms govern the PlanTrackAnalyze website, available app editions, supporting online services, approved downloads and related customer functions supplied by DRSOLID LLC ("DrSolid", "we", "us" or "our"). Together, these are the "Service". References to a platform or feature apply only when that platform or feature is actually offered.
Important allocation of responsibility. The Service can contain mistakes and experience interruptions or data loss. You must assess its suitability and check important results. Sections 13–16 address errors, storage and recovery limitations, excluded losses, the aggregate liability limit, and protections for DrSolid and the persons through whom it operates.
Research and commercial statistics. Section 7 authorizes research, market research, statistical analysis, benchmarking, pricing analysis and use of qualifying non-identifying results for development, commercial reports and marketing. The Privacy Policy explains the corresponding data handling and required choices.
1. Contracting parties, acceptance and applicable documents
1.1 Company. Your contracting Service provider is DRSOLID LLC, a Wyoming limited liability company. Our correspondence address is 2106 House Ave, Suite 498, Cheyenne, Wyoming 82001-3737, United States. Contact support@plantrackanalyze.com for Service, complaint, privacy and contractual correspondence.
1.2 Customer and users. The "Customer" is the individual purchasing or establishing the Service for their own use, or the organization expressly represented when its account is established. "You" refers to the Customer and, for provisions governing use, each person who accepts these Terms and uses the Service. A person accepting for an organization represents that they have authority to agree for it. Using the Service in an authorized representative role does not by itself make that person a personal guarantor of the organization's debts.
1.3 Acceptance. These Terms apply when you accept them through the presented acceptance process or otherwise enter an agreement that validly incorporates them. The applicable purchase confirmation describes your paid offer. Do not proceed with a transaction or use requiring acceptance if you do not agree. Merely visiting a publicly accessible legal page is not treated as consent to background recording or optional personal-data uses.
1.4 Other documents. The Privacy Policy explains information handling. Applicable store rules, purchase conditions, feature-specific disclosures and permissions also apply to their subject matter. A separately agreed written order controls an expressly identified commercial variation. Appendix A addresses platform and regional provisions. Appendix B supplies processing terms only where its stated conditions apply. Mandatory law and mandatory store provisions take priority over an inconsistent term to the extent required.
1.5 Scope of offers. No statement in these Terms promises a platform edition, feature, integration or payment channel that has not been supplied. A roadmap, example, demonstration, support discussion or general description is not a separate promise of future development, guaranteed results or support from any particular individual. This provision does not negate an express description or commitment that forms part of your actual purchase under applicable law.
2. Eligibility, accounts and Fleet authority
2.1 Self-service availability. Individuals and organizations may acquire available offers through authorized distribution channels without being an incorporated business or obtaining individual sales approval. You must have legal capacity to enter the agreement and satisfy applicable store, legal, territorial and account requirements. Finding or downloading the app does not remove the permitted-use rules below. The Service is not directed to children or offered as a child-monitoring service.
2.2 Fleet and account control. A "Fleet" is the account workspace holding connected phones, vehicles, Plans, Actions and related records. A "Tracked Phone" is a connected installation enabled for the Fleet's recording functions. Use the correct supported sign-in account and accurate account information. In the current Android service, the selected Google owner account identifies its Fleet; a different account is not an automatic substitute or a guaranteed route to the same records and purchases.
2.3 Customer administration. The Customer is responsible for selecting and supervising its authorized users, phones, assignments, data inputs and sharing recipients; protecting its accounts, devices and invitation/access links; keeping appropriate business authority over the sign-in account; and promptly reporting suspected unauthorized activity. Do not share credentials or links in a way that grants unauthorized access. We may require proportionate verification for account-sensitive changes and disputed instructions.
2.4 Instructions. Within applicable security and verification requirements, DrSolid may act on instructions received through an authenticated account or other reasonably verified authority. The Customer must ensure its personnel understand the consequences of administrative, sharing and deletion actions. DrSolid does not undertake to resolve the Customer's internal ownership or employment disputes or to certify every instruction's business wisdom.
3. Limited rights to use the Service
3.1 Permission. Subject to these Terms, the relevant purchase and applicable store rules, DrSolid permits you to access the supplied Service and install and use approved app copies on devices you are authorized to use, for your lawful activities and within your access and purchased capacity. This is a limited, non-exclusive permission, not a transfer of software, source code or other intellectual property. It continues while the relevant permission or entitlement remains in effect, subject to the termination provisions and mandatory existing-user rights.
3.2 Rights holders. DrSolid, its technology licensors and other rights holders retain their respective rights in the software, website, designs, methods, documentation, branding and other Service material. Customer information remains distinct from those rights. No source access, development permission, ownership interest or right to another edition is granted by a subscription. Third-party and open-source material remains subject to its applicable license, including rights that cannot be restricted by these Terms.
3.3 Restrictions. Except where a right is independently supplied by applicable law or an applicable third-party license, do not copy or distribute the Service beyond the permitted installation, ordinary output and sharing functions; sublicense or commercially resell access without approval; reverse engineer, decompile or extract nonpublic software; remove required rights notices; bypass entitlement, access or security controls; introduce malicious code; conduct unauthorized security or load testing; scrape nonpublic data; or interfere with other accounts or the Service. Do not use access to misappropriate proprietary material or build an unauthorized substitute from it.
3.4 Feedback. You may provide suggestions voluntarily. You permit DrSolid and its authorized developers to use feedback to improve or develop products without an obligation to implement it, attribute it or pay for it, unless separately agreed. This permission does not convert confidential Fleet records, identifiable testimonials or an individual's personal information into unrestricted promotional content.
4. Customer responsibilities and prohibited use
4.1 Lawful authority. You are responsible for the authority to connect phones, record and submit information, assign vehicles and operators, instruct processing, and share results. Provide affected people with required notices and obtain the permissions or other lawful authority required for your use, including workplace, surveillance, privacy, employment and off-duty requirements. Device ownership, subscription payment or your own acceptance does not supply every permission required from another person.
4.2 Use restrictions. Do not use the Service for stalking, covert surveillance, unlawful monitoring, harassment, unlawful discrimination, exploitation, fraud, infringement or other unlawful activity. Do not hide or circumvent a tracking disclosure, notification, permission or Stop control. Monitoring of other people must also fall within the uses permitted for the app by its distribution platform; a general-purpose subscription is not permission to conduct platform-prohibited personal surveillance.
4.3 Information and results. You are responsible for the accuracy, relevance, authority and suitability of the information you enter or instruct us to process, and for your decisions using outputs. Check important results against appropriate independent sources before using them for payment, invoicing, employment, disciplinary, safety, customer or regulatory decisions. Your own contractual or legal recordkeeping and verification requirements remain your responsibility.
4.4 Safe operation. Do not interact with the Service in a way that distracts a driver or creates danger. Use appropriate mounting, equipment, connectivity and operating procedures. The Service is not an emergency response, safety-critical control, certified navigation, guaranteed theft-prevention, payroll-certification or regulatory-record system. Do not rely on it as the sole safeguard against personal injury, property loss or business interruption.
4.5 No routine certification. DrSolid supplies capabilities; it does not undertake to routinely audit or certify each Customer's monitoring arrangements, employment practices, data accuracy or legal compliance. We may investigate suspected misuse, request relevant evidence, restrict access or remove unlawful material as appropriate. These reserved powers are not a promise to identify or prevent every misuse.
5. Recording, devices and technical dependencies
5.1 Requirements. Functions depend on the supplied edition, compatible hardware, operating system, network access, permissions, configuration, supported integrations and available subscription authorization. You are responsible for your devices, connectivity and third-party equipment and charges unless your offer expressly states otherwise. A listed or saved equipment model does not guarantee supported measurements or compatibility.
5.2 Background recording. After the Tracked Phone operator receives the disclosure, agrees and grants required permissions, recording may start automatically when the manager selects the Phone Card and subscription access is available. Enabled recording can continue while the app is not visible or the screen is off and may resume after supported interruptions. Operating-system restrictions can prevent or delay operation and may require local action. The current app does not impose kiosk mode, compulsory permissions or guaranteed device-recovery controls.
5.3 Stop and offline operation. The local Stop control remains in effect until the operator starts recording again. Manager deactivation and changed server authorization reach an offline phone only when communicated to it. Previously collected evidence may still upload or finish processing after new collection stops. Stopping, unpairing, removing a Phone Card, uninstalling or clearing local app data is not necessarily deletion of server-held records or cancellation of billing.
5.4 Estimates and missing inputs. Locations, routes, stops, Site intervals, activity, matches, distances, fuel and cost results are calculations from available evidence and configuration, not conclusive proof of a physical event. Missing, delayed or inaccurate evidence and optional or user-entered values can affect results. An absent reading, zero value or estimate does not necessarily establish that an event or cost did not occur. A later recalculation may differ from an earlier display.
6. Customer information and operational permission
6.1 Customer Information. "Customer Information" means information and content you or authorized users provide, or that authorized use records or generates for your account or Fleet. It includes business records, location and motion evidence, device and equipment data, files, instructions and derived results. You retain the rights you hold in it, subject to the permissions below and other persons' rights.
6.2 Operational authorization. You authorize DrSolid, acting through its authorized personnel, developers, technology licensors and service providers, to receive, host, store, reproduce, organize, index, transmit, process, analyze and display Customer Information to supply, administer, maintain, support, secure and improve the Service and to perform the activities described in the Privacy Policy. This includes synchronization, caching, replication, backups where used, diagnostic records, complete Fleet snapshots where reasonably required, troubleshooting, testing, migration, restoration attempts, subscription verification, accounting, financial verification and misuse prevention. Both automated processing and authorized human access may be involved.
6.3 Necessary rights. To the extent you hold relevant intellectual-property, database or confidentiality rights, you grant the non-exclusive, worldwide, royalty-free permissions necessary for those described activities, including use by authorized providers and an authorized successor to the customer operation. The permission lasts for the applicable Service processing and any lawful retained-purpose processing afterward. It does not create ownership of the underlying personal information or excuse a legally required consent, deletion or processing limitation.
6.4 Routine activities and support. Separate approval is not required for each action within the authorized scope unless applicable law or platform rules require it. In particular, an in-app support or custom-feature request authorizes the disclosed diagnostic Fleet snapshot and examination of relevant records and attachments. An ordinary email inquiry is available where a snapshot is unnecessary. You remain responsible for having authority to submit information about other people; DrSolid remains responsible for its own processing as required by law.
6.5 Not an archival promise. Permission to create backups, copies or snapshots does not require a particular backup frequency, historical version, retention period or recovery result. The Privacy Policy describes retention and deletion. Sections 12–16 address the consequences and contractual allocation of failures.
7. Research, statistics, market analysis and commercialization
7.1 Customer acknowledgment and agreement. You acknowledge and agree that DrSolid may use lawfully held Customer Information for research, market research, statistical conclusions, operational benchmarking, product development and improvement, demand and pricing analysis, commercial reports and marketing, as described in Section 6 of the Privacy Policy. These uses may be undertaken for DrSolid's commercial benefit and are not limited to supplying an individualized report to you.
7.2 Scope. The permission includes analyzing average speed or travel time on a road; activity, stopping or Site patterns; fuel consumption by area, truck make, model, configuration or other relevant characteristics; vehicle performance and efficiency; rates, prices and costs; and other relevant operational or market relationships. Subject to the applicable privacy and data-use requirements, suitable contributions may be combined across Fleets and with other lawfully usable information. Identifiable source records may be processed to prepare and evaluate those analyses where that source processing is authorized and lawful.
7.3 Non-identifying commercial outputs. Research results published externally, commercially supplied or used in public marketing under this permission must be genuinely anonymized or aggregated so that neither a person nor a contributing Customer or Fleet is reasonably identifiable in the intended context. Customer names, identifying account or vehicle details, identifiable customer-specific pricing and raw individual location histories are not published through this permission. We may combine, generalize, suppress or withhold results where needed; merely removing names does not satisfy the condition.
7.4 Commercial use without compensation. Subject to that condition, DrSolid may retain, combine, use, publish, distribute, license and sell the resulting anonymized datasets, statistics, benchmarks, conclusions and reports and use them in marketing and commercial decisions. You grant any permission within your authority needed for those uses without a payment, royalty, attribution, participation or further customer approval for each qualifying output. This does not grant rights belonging to a third-party data or map provider. DrSolid and the relevant rights holders retain rights they lawfully create in their methods and research materials; your participation does not give you ownership of them.
7.5 Continuing use and required permissions. Qualifying non-identifying results may continue to be used after cancellation or deletion of the source account. These permissions do not authorize selling personal or sensitive app-user information, ignoring a valid withdrawal or deletion right for identifiable records, or bypassing a mandatory consent or restriction on independent use or combining personal data. The Privacy Policy governs those distinctions. Acceptance records your contractual permission; a separate legally or platform-required consent must still be obtained before the corresponding processing. No particular research output, market coverage or commercial return is promised.
8. Sharing, exports, communications and third-party services
8.1 Customer-directed access. Review the information, recipient and scope before generating or distributing an invitation, shared session or export. A usable bearer link can provide access to its permitted information. The Customer is responsible for its selected recipients and their authorized use. Revocation cannot recall an independently downloaded copy and may not end an already issued short-lived file URL before its expiry.
8.2 Exports. Available export functions cover their specified records and formats; they are not a promise of a full database export or an export of every raw file. Verify any export you intend to rely on and maintain independent records where necessary. Mandatory access or portability rights are addressed through the Privacy Policy and are not limited to a particular export button.
8.3 Third-party dependencies. App stores, sign-in, maps, hosting, content delivery, messaging, email, networks, devices and equipment can have separate terms, limits and failures. DrSolid does not control an independent provider merely because the Service uses it. The Service includes Google Maps features and content. Their use is subject to the current Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. Required provider notices and attribution must be preserved. These Terms do not create an additional warranty that a third-party service or device will remain available or compatible.
8.4 Communications. You authorize appropriate electronic account, security, billing, support and contractual communications to the contact or Service channel associated with your account. Keep it accessible. Promotional communications and their choices follow the Privacy Policy and applicable requirements; acceptance of these Terms is not substituted for separately required marketing consent.
9. Subscriptions, capacity, trials and payment
9.1 Your offer. The actual purchase screen and confirmation identify the price, currency, billing period, capacity, trial or introductory offer, renewal arrangement and any relevant taxes. Do not purchase solely on an old screenshot or illustrative price. An available subscription purchases the stated Service access or capacity, not ownership of a phone, truck, software or customer dataset.
9.2 Recurring charges. Where an offer is auto-renewing, you authorize recurring charges through its payment provider at the disclosed interval until cancellation takes effect or the provider ends the subscription. Trials or introductory periods convert on their disclosed terms unless canceled in time. Eligibility and duration depend on the offer actually presented; a trial is not promised for every account, capacity change, reinstall or later subscription.
9.3 Verification and capacity. Access depends on a valid purchase and successful entitlement verification. Pending, declined, refunded, revoked or expired purchases may not authorize recording. Capacity is the purchased limit for simultaneously authorized Phone Cards, not guaranteed successful recording time. Deactivating a Phone Card releases its assigned capacity through the Service; it does not reduce the price of the subscription already purchased or automatically request a lower-priced plan.
9.4 Changes of capacity. Upgrades, downgrades, replacements, proration and their timing follow the actual offer and payment-provider process. A downgrade may require choosing which phones stop so that the Fleet meets the reduced capacity. A replacement purchase does not automatically provide a new trial or a cash refund. Provider confirmation and the effective entitlement govern, not merely opening a purchase screen.
9.5 Cancellation. For Google Play purchases, complete cancellation through Google Play's subscription controls. Merely opening that page is not cancellation. Cancellation normally prevents the next renewal while access continues for the remaining verified paid or trial period, subject to the provider's applicable rules. Other approved payment routes use their identified cancellation process. Stopping recording, removing the app, not using capacity or requesting data deletion does not itself cancel recurring billing.
9.6 Refunds. Refunds and remedies are provided where required by applicable law, the payment platform or an express offer. No additional general change-of-mind or non-use refund entitlement is supplied by these Terms. Any voluntary goodwill adjustment is specific to the case and does not create an ongoing refund guarantee. This provision does not exclude mandatory rights concerning a defective or undelivered service.
9.7 Prices and future offers. DrSolid may change offers and future renewal prices through the applicable notice and consent process. An accepted current-period purchase is not retrospectively repriced by an ordinary website update. No permanent price lock, future trial, continuing free tier or future edition is promised unless expressly included in your purchase. You may stop future renewals through the applicable cancellation route.
9.8 Accurate use of payment channels. Use a payment channel actually offered for the relevant edition. An approved direct APK is a distribution method, not by itself a separate website checkout or free subscription. Do not misrepresent purchases, circumvent capacity or use fraudulent reversals. Legitimate refund and payment-dispute rights remain unaffected.
10. Support, changes and Service availability
10.1 Support scope. We provide the support included in the Service and required by applicable law or platform rules. No additional contractual response deadline, repair deadline, uptime percentage, service credit, dedicated support person, guaranteed recovery or unlimited development commitment is supplied. A support or custom-feature request does not oblige DrSolid or a particular developer to create a feature or make an unagreed change.
10.2 Operation and updates. DrSolid may maintain, correct, update or change technical methods, supported devices, interfaces and features for legitimate operational, security, legal, platform or commercial reasons. You may need to install an available update or adjust a supported configuration. We do not promise identical features on every platform or permanent support for an old version. Changes to an already paid entitlement remain subject to its express commitments and applicable requirements.
10.3 Interruptions. Maintenance, faults, account problems, malicious activity, provider decisions, connectivity, force majeure and other events can interrupt access or processing. We do not promise a particular restoration result or time. Events outside reasonable control may excuse affected performance to the extent the law permits, but not an obligation or remedy that cannot be excluded.
10.4 Evaluations. A feature clearly identified as a preview, test or experimental feature may be incomplete and may change or be withdrawn. Do not rely on such a feature as your sole production record or safeguard. Applicable rights concerning an actual paid offer remain unaffected.
11. Restriction, suspension and termination
11.1 Grounds. DrSolid may restrict, suspend or terminate affected access where reasonably necessary because of material breach, unlawful or prohibited use, nonpayment or loss of valid entitlement, a security or fraud risk, binding legal or platform requirements, inability to continue supplying an affected function, or legitimate discontinuation of the Service. Action may be immediate where notice would create risk, be unlawful or defeat the protective purpose. Otherwise, the notice and opportunity to address the matter are those appropriate to the circumstances and required by applicable rules.
11.2 Discontinuation and paid periods. We may decline a future renewal or discontinue an offering for legitimate business reasons. Where access ends before a paid commitment is fulfilled, DrSolid will address the remaining entitlement through continued authorized service, a permitted transition or the remedy required by applicable law, platform rules or the purchase. Accrued obligations remain subject to the applicable law and purchase; discontinuation does not itself create an additional compensation entitlement beyond them.
11.3 Your departure. You may stop using the Service and cancel future renewal through the relevant payment route. Account or data deletion is requested separately as described in Section 12 and the Privacy Policy. Non-use does not automatically trigger account deletion or a refund.
11.4 Consequences and survival. When a permission or entitlement ends, you must stop the use it no longer authorizes. Limited retained processing, accrued payment obligations, intellectual-property provisions, qualifying anonymous-research rights, applicable liability protections, a covered indemnity and dispute provisions continue to the extent needed for their purpose. Termination does not create an unlimited obligation to host or recover records, and does not remove mandatory retention, deletion or existing-user rights.
12. Retention, account deletion and independent records
12.1 Cancellation is not deletion. Canceling a subscription does not request deletion of your account or Fleet. The current Service keeps the other Fleet records for continuing access or return, subject to the Privacy Policy and lawful retention. After subscription access ends, raw accelerometer recordings may be manually deleted to manage storage; this particular cleanup does not delete other Fleet records or location history. Recalculations needing deleted raw evidence may be unavailable.
12.2 Deletion request. Use the route in the Privacy Policy. The current Android route is Admin → Manage subscription in Google Play → Delete account and data → Review deletion request → Request permanent deletion. The Fleet owner confirms the named account and entire Fleet. Requests are verified and processed; a receipt is not a completed-erasure notice. You need not first cancel a subscription to submit the request, but must manage renewal separately to prevent further charges.
12.3 Scope and authority. Before instructing whole-Fleet deletion, verify the account, understand its effect on authorized users, and retain any independent records you lawfully need. DrSolid may carry out a properly authenticated or verified deletion instruction within its confirmed scope without obtaining a separate approval from every Fleet participant, except where required. Claims about a person's own information are distinguished from authority to delete the whole Fleet.
12.4 Effect of authorized deletion. You acknowledge that completed deletion can be permanent, end access and prevent reconstruction or restoration. Within the scope of a lawful, authorized instruction, deletion is not a failure to preserve data or a promise to recreate it later. No restoration or compensation entitlement arises solely because the Customer later changes its mind, replaces personnel or resubscribes. This does not excuse deletion outside the authorized scope or remove a mandatory remedy.
12.5 Copies and recordkeeping. Live records, local evidence, snapshots, exports and provider recovery copies can be separate. Deletion and retained exceptions follow the Privacy Policy and applicable processing terms. Do not assume that the Service maintains a recoverable copy of every record or meets a special statutory archival requirement. Maintain independent records and verify available exports when your business or other purposes require them; this is not an assurance that every record is exportable or recoverable through the app.
13. Errors, storage limitations and warranty exclusions
13.1 Scope of this section. Sections 13–16 allocate the risks of the Service to the extent those risks may lawfully be allocated. The mandatory exceptions in Section 16 and Appendix A apply to each exclusion and limit. They do not remove an express, enforceable commitment in your actual purchase.
13.2 As supplied; no additional warranties. EXCEPT FOR EXPRESS COMMITMENTS AND RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, THE SERVICE, ITS RESULTS AND RELATED MATERIALS ARE SUPPLIED "AS IS" AND "AS AVAILABLE". DRSOLID AND THE PROTECTED PARTIES EXCLUDE IMPLIED OR STATUTORY WARRANTIES AND CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, COMPATIBILITY, SECURITY, UNINTERRUPTED AVAILABILITY AND ERROR-FREE OPERATION TO THE EXTENT THOSE WARRANTIES OR CONDITIONS CAN LAWFULLY BE EXCLUDED.
13.3 Errors and unintended effects. The Service can contain bugs, programming or configuration mistakes, omissions and incorrect calculations. Saving, changing, linking, processing, displaying, sharing, exporting, migrating, applying instructions and deleting information can fail or have unintended effects. Outputs and actions may be delayed, inaccurate, incomplete, duplicated or associated incorrectly. DrSolid does not guarantee that every defect will be found, prevented or corrected or that an attempted fix will avoid other effects.
13.4 Data and recovery. Collection, transmission, synchronization, storage, backup and restoration can fail. Information may be missing, overwritten, changed, corrupted, lost, deleted, disclosed without authority or inaccessible. No additional promise is made that data will always be preserved, secure, unchanged, current, available or recoverable. An investigation, snapshot, backup, repair attempt or assistance does not guarantee successful recovery or create a separate archival obligation.
13.5 Results and suitability. DrSolid does not guarantee a business outcome, cost saving, profit, regulatory acceptance, correct employment determination, uninterrupted tracking or successful identification of every movement, stop, Site visit, fuel event or Action. You must assess fitness for your purposes and check consequential results. Performance on a previous occasion or device does not guarantee future performance.
13.6 No informal expansion. Assistance, advice, demonstrations, diagnostic efforts or voluntary work do not create a new warranty, service level or compensation undertaking unless DrSolid expressly agrees to it through an authorized representative. Nothing here excludes liability for a statement or representation where exclusion is prohibited by law.
14. Excluded losses
14.1 Excluded categories. SUBJECT TO SECTION 16 AND APPENDIX A, TO THE EXTENT LAWFULLY EXCLUDABLE, DRSOLID AND THE PROTECTED PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE LOSS OR DAMAGES ARISING FROM OR CONNECTED WITH THE SERVICE, THESE TERMS, CUSTOMER INFORMATION OR USE OF RESULTS.
14.2 Specifically identified losses. Under the same conditions, the exclusion extends to loss of or damage to data and the cost of reconstructing or recovering it; lost profits, revenue, business, opportunities, anticipated savings, goodwill or reputation; business interruption, downtime, wasted expenditure, substitute-service costs, operational delays and losses arising from Customer decisions, instructions or reliance on outputs. These named exclusions apply to the extent lawful whether a particular loss is characterized as direct, indirect or consequential. A mandatory refund or other non-excludable remedy is not removed by relabeling it as an excluded loss.
14.3 Causes and legal theories. The applicable exclusions and limits cover claims arising from mistakes, omissions, ordinary negligence, defective design or programming, configuration, processing, maintenance, support, security or deletion; acts or omissions of DrSolid or a Protected Party, whether solely or concurrently; third-party or customer events; and claims in contract, tort, statute or another legal theory, insofar as the relevant liability can lawfully be excluded or limited. They are not confined to events outside DrSolid's control and may apply even if the possibility of the loss was identified in advance.
14.4 Customer-controlled loss. DrSolid does not assume responsibility for Customer decisions, unauthorized instructions or disclosures, unsuitable equipment, unlawful monitoring, failure to maintain required independent records, or other matters within the Customer's control. Any reduction or exclusion for such matters is limited to the loss attributable to them and remains subject to applicable law.
15. Aggregate limit and Protected Parties
15.1 Monetary ceiling. SUBJECT TO SECTION 16 AND APPENDIX A, FOR ALL REMAINING MONETARY LIABILITY THAT MAY LAWFULLY BE LIMITED, THE COMBINED AGGREGATE LIABILITY OF DRSOLID AND ALL PROTECTED PARTIES TO YOU ARISING FROM OR CONNECTED WITH THE SERVICE AND THESE TERMS WILL NOT EXCEED US$100.
15.2 Application. The ceiling is combined across the covered claims and defendants; it is not a separate allowance per event, record, phone, user, legal theory, Protected Party or related proceeding. A claimant is not entitled to the ceiling merely by making a claim. No double recovery is available. The ceiling does not reduce a refund, re-performance or other remedy that applicable law prohibits limiting in that way.
15.3 Protected Parties. "Protected Parties" means DrSolid's relevant past, present and future members, managers, officers, employees, developers, contractors, agents, advisers, technology licensors, affiliates, service providers and authorized distributors, and their relevant personnel, acting in connection with the Service. The term includes individuals in those roles without naming them or making them separate contracting suppliers.
15.4 Direct benefit; no personal guarantee. The Protected Parties are intended third-party beneficiaries of the applicable licenses and protections in Sections 3, 6, 7 and 13–19 and may rely on and enforce them to the extent lawful. Subject to non-excludable liabilities, you look to DrSolid as the contracting supplier, not to an individual's personal undertaking merely because that individual developed, administered, supported or represented the Service. These Terms do not create a personal guarantee of DrSolid's obligations.
15.5 Allocation. The exclusions and ceiling are intended to allocate risk in relation to a standard-priced Service rather than make DrSolid or its personnel an insurer of the Customer's records, decisions or downstream business losses. Each lawful exclusion and the residual ceiling is intended to operate independently to the extent the law permits, including where a particular remedy does not achieve its purpose. Mandatory rules governing ineffective or unfair terms remain controlling.
16. Mandatory rights and limits on the exclusions
16.1 Non-excludable matters. Nothing in these Terms excludes or restricts a liability or remedy that the law applicable to the claim prohibits excluding or restricting. This includes applicable restrictions concerning fraud or fraudulent misrepresentation, death or personal injury caused by negligence, willful or gross misconduct, mandatory consumer guarantees, statutory data-protection rights and other nonwaivable duties. A reference here does not voluntarily extend a jurisdiction's rule to a claim to which it does not apply.
16.2 Concrete effect. Where a particular disclaimer, loss exclusion, cap, indemnity, forum or other provision cannot lawfully apply to you or the particular claim, it does not apply to that extent. Mandatory remedies, including applicable repair, re-performance, replacement, price reduction, refund or compensation rights, remain available. Appendix A identifies relevant regional and platform qualifications.
16.3 No waiver by acknowledgment alone. Your acknowledgment of a risk is not treated as waiving a right that cannot be waived. Likewise, a Customer's acceptance cannot waive independent rights belonging to another person who has not validly agreed or restrict a regulator's authority.
17. Customer indemnity for third-party claims
17.1 Business-customer scope. Where you acquire or use the Service for business or professional purposes, you must defend and indemnify DrSolid and the Protected Parties against third-party claims, covered judgments, reasonable settlements and reasonable legal defense costs to the extent caused by your or your authorized users' unlawful monitoring, unauthorized processing instructions or disclosures, infringement through submitted content, material breach of the permitted-use or authority obligations, or other unlawful misuse of the Service.
17.2 Causation and exclusions. The indemnity is limited to loss attributable to the specified Customer conduct; it does not shift a Protected Party's independently caused loss to the Customer. Mixed responsibility is allocated to the covered Customer-caused part. No amount is due to the extent the indemnity is prohibited or unenforceable under applicable consumer, small-business or other mandatory rules. It is not a personal guarantee by an ordinary employee using the Customer's Fleet and does not apply to a Customer acting solely for personal, non-business purposes.
17.3 Defense process. The recipient of a claim will give reasonably prompt notice and information needed to address the covered matter; delay reduces the obligation only to the extent it materially prejudices the defense. The indemnifying Customer must provide a competent defense with counsel reasonably acceptable to the protected recipient. If it does not do so, the recipient may defend the covered matter and recover reasonable covered costs. No settlement may admit fault for, require payment or action by, disclose protected material of, or restrict a Protected Party without its consent. Reasonable costs of a conflict requiring separate representation are covered to the extent attributable to the covered claim. Recovery cannot duplicate another payment for the same loss.
18. Disputes, governing law and forum
18.1 Initial contact. Send a dispute to support@plantrackanalyze.com with your account or Fleet reference, the relevant facts and the remedy sought so that DrSolid has a reasonable opportunity to address it. This does not require delaying urgent relief, missing a legal deadline or foregoing a mandatory complaint or payment-dispute route. No shortened contractual claim deadline is introduced.
18.2 Law and courts. Subject to mandatory protections, these Terms and the contractual relationship are governed by Wyoming law, excluding conflict rules that would substitute another law. The state courts located in Laramie County, Wyoming, and the United States District Court for the District of Wyoming where federal jurisdiction exists, are the agreed forums for covered disputes. Mandatory rights to the law or courts of a consumer's residence or another protected forum are not excluded.
18.3 Costs and procedure. Costs, fees and sanctions are governed by applicable law, together with any covered third-party costs under Section 17. Nothing restricts legally protected complaints, truthful reviews, regulatory cooperation or a nonwaivable representative remedy.
19. General provisions
19.1 Changes to these Terms. DrSolid may update these Terms for legitimate changes in the Service, operations, commercial offers, legal requirements or platform conditions. We give the notice and obtain acceptance required for the change. An update does not retrospectively impose a new charge, remove accrued mandatory rights or supply consent for an incompatible new data use. No additional fixed advance-notice period is promised where one is not required. A Customer may decline future renewals rather than accept a new future offer, subject to existing obligations.
19.2 Assignment and providers. You may not transfer the account or contractual rights to an unrelated person without an available approved process or DrSolid's permission, except where an applicable store rule or law supplies that right. DrSolid may use authorized providers and may transfer the customer contract and operation to an eligible successor in a lawful business transaction, with required notices, consents and safeguards. An assignment does not itself erase accrued obligations, reduce mandatory rights or authorize a new incompatible data use.
19.3 Entire agreement and variations. These Terms, applicable purchase conditions and incorporated subject-specific documents form the agreement for the defined Service. A separate negotiated variation must expressly identify the change and be accepted by an authorized DrSolid representative. Silence, a support ticket, a request for a feature or a Customer's purchase-order boilerplate is not acceptance of additional obligations. No provision supersedes an express commitment or representation that mandatory law makes part of the transaction.
19.4 Severability and waiver. A provision that cannot lawfully operate is ineffective to the required extent; the remaining provisions continue where legally possible. Reformation is permitted only to the extent the competent law allows, not presumed. Failure or delay to enforce a right is not a continuing waiver. A waiver must be given by an authorized representative for its stated scope.
19.5 Relationship and beneficiaries. The parties remain independent. No partnership, employment, fiduciary relationship or agency to bind the other is created merely by use. Except for the Protected Parties' specified rights, applicable store beneficiaries and rights supplied by law, no other third-party enforcement right is intended. Neither the privacy notice nor these Terms makes an individual a co-debtor for Company obligations.
19.6 Language and contact. The English text is the reference text except where a legally required or expressly controlling translation applies. Contact DRSOLID LLC at support@plantrackanalyze.com or the correspondence address in Section 1.
Appendix A. Platform and regional provisions
A1. Application. This Appendix modifies the relevant provision only where its platform or legal condition applies. It does not promise an edition that has not been released, replace the applicable purchase confirmation or extend every region's rights worldwide.
A2. Google Play and direct Android distribution. Google Play purchases, renewals and cancellation follow the applicable Play process and mandatory rules. DrSolid remains the provider of its Service, not Google. Approved direct APK installation does not guarantee Play billing availability on that installation or grant access beyond a recognized entitlement. Any store-required end-user installation, family-sharing or other existing-user rights take priority over an inconsistent app-use restriction.
A3. Apple App Store editions. For an Apple edition, Apple's applicable Standard Licensed Application End User License Agreement remains the app license unless DrSolid supplies a separately identified custom license accepted for that edition. These Terms supplement that license for the hosted Service and Customer relationship without reducing required Apple usage rights. Apple is not the supplier of DrSolid's hosted Service and does not assume DrSolid's maintenance, support or product-claim responsibilities merely by distributing the app. Apple and its subsidiaries receive the third-party enforcement benefit required by the applicable app license. Required Apple warranty-refund and other mandatory provisions remain controlling. Manage an Apple-billed subscription through Apple's identified process. Permissions, account controls and features depend on the Apple edition actually supplied.
A4. Microsoft Store editions. The applicable Microsoft Store license and purchase conditions govern their assigned subjects. These Terms apply to DrSolid's Service without displacing mandatory Store terms or rights supplied by the applicable standard app license. Microsoft is not made the operator or guarantor of DrSolid's Service. The actual offer identifies whether Microsoft or another authorized provider processes payment and cancellation. Windows permissions, account controls and available features depend on the supplied edition, not on the Android description.
A5. Australia. Where the Australian Consumer Law applies, its consumer guarantees and other mandatory protections, including applicable small-business unfair-term protections, are not excluded. Applicable remedies for a major failure or other breach, and compensation that cannot lawfully be excluded, remain available. For a supply not ordinarily acquired for personal, domestic or household use or consumption, only where section 64A permits and the limitation is fair and reasonable, DrSolid limits liability for a relevant guarantee failure to its choice of the statutorily permitted repair, replacement, equivalent supply, re-supply or corresponding cost remedy. That option does not limit a liability section 64A does not permit limiting.
A6. EEA, United Kingdom and other protected consumers. Where mandatory consumer law applies, statutory conformity, due-care and digital-content or service remedies, required updates and applicable cancellation or withdrawal rights are preserved. The warranty exclusions, named-loss exclusions and monetary ceiling do not override those rights. Where a valid separate request and acknowledgment are needed to begin digital supply during a withdrawal period or affect that right, general acceptance of these Terms alone is not substituted for them. Mandatory home-country law and forum rights take priority over Section 18. This does not create an additional voluntary cooling-off period in jurisdictions where none applies.
A7. United States and other mandatory limits. Applicable state or other local limits on warranty disclaimers, liability exclusions, privacy waivers, forum clauses and unfair terms remain controlling. The broader exclusions or cap operate only on claims and losses they can lawfully cover. No required refund or independent statutory remedy is waived merely because a loss is described elsewhere in these Terms.
Appendix B. Applicable customer data-processing terms
B1. When this Appendix applies. This Appendix applies only to Customer personal information that DrSolid processes on the Customer's behalf where applicable privacy law requires a controller–processor, business–service-provider or equivalent contract. "Customer Personal Data" means that information. It does not label every DrSolid activity as processing on the Customer's behalf. For its independently determined purposes described in the Privacy Policy, DrSolid assumes the role and obligations that the applicable law assigns to that activity. No independent-purpose use is authorized where that use is prohibited by the applicable processing role or a binding restriction.
B2. Subject, duration and instructions. The processing concerns providing and supporting the Customer's PlanTrackAnalyze Fleet operation during the Service relationship and the lawful return, deletion or restricted retention period afterward. The Customer's documented instructions comprise these Terms, the applicable Privacy Policy descriptions for customer-directed processing, its settings and feature selections, authorized support or deletion requests, and further lawful instructions accepted within the Service's scope. DrSolid processes Customer Personal Data only on those instructions, including instructions concerning transfers, unless applicable law requires otherwise; we inform the Customer of the legal requirement where permitted. We inform the Customer when we consider an instruction infringes applicable data-protection law and may suspend the affected processing while it is resolved.
B3. Nature, purpose and categories. Processing includes collection, recording, organization, storage, retrieval, consultation, calculation, authorized disclosure, synchronization, diagnostic copying, restriction, return and erasure for the Fleet, tracking, planning, analysis, sharing and support functions. Information may include identifiers and account/access records; customer, worker and contact details; vehicle and equipment records; precise location and movement evidence; Plans, Actions, Sites, assignments and derived results; costs, files and communications. Individuals may include the Customer, authorized users, drivers, employees, contractors, business contacts, sharing recipients and persons whose information is lawfully entered. Location is handled as sensitive where the applicable law so classifies it. The Customer must not instruct processing of unrelated special-category or highly sensitive records for which the Service is not arranged.
B4. Customer duties. The Customer determines the lawful purpose and authority for its instructions, provides required notices, maintains necessary consents or other bases, and uses the Service consistently with the applicable law. It identifies relevant restrictions and cooperates with proportionate requests necessary to perform the processing lawfully. The operational permission does not authorize it to waive another person's rights. Where anonymization is lawfully performed on its instructions, the resulting genuinely non-identifying information is treated as described in Section 7; coded or linkable records are not treated as anonymous merely because a name is absent.
B5. Personnel and security. DrSolid limits authorized processing to persons with the relevant duties and ensures that authorized persons are subject to confidentiality obligations or an appropriate statutory duty. We implement the technical and organizational measures required by applicable law, taking account of the nature and risks of processing. Relevant measures include access authentication and authorization, protected transport and appropriate operational access controls. This does not promise an unverified certification, zero incidents or a particular recovery service. Where required, measures include appropriate availability, resilience, restoration and effectiveness assessment; the general Service disclaimers do not remove those statutory duties.
B6. Subprocessing. The Customer generally authorizes use of the providers identified for the relevant functions in the Privacy Policy, including the applicable Google/Firebase/Google Cloud entities for hosted Fleet processing and relevant website, content or communications providers to the extent they process Customer Personal Data for the instructed operation. DrSolid provides the current relevant subprocessor identities and locations on request and, where required, gives advance information about intended additions or replacements and an opportunity to raise a reasoned data-protection objection. Applicable provider subprocessor arrangements also apply. Required equivalent data-protection obligations are imposed by contract, and DrSolid retains the responsibility for subprocessors required by applicable law. An unresolved objection is addressed through a lawful alternative or termination of the affected processing and the applicable entitlement remedy; it does not require unlimited custom development.
B7. Assistance and incidents. Taking account of the nature of processing and information available to it, DrSolid provides assistance required by applicable law with individuals' requests, security, breach handling, impact assessments and regulator consultation. We notify the Customer without undue delay after becoming aware of a personal-data breach affecting Customer Personal Data where the law requires that notification, and provide available information and updates required for its response. A report is not an admission of liability. The Customer remains responsible for its own notices and decisions except where the law allocates them otherwise. Extra bespoke work outside mandatory assistance may be separately scoped and priced; payment is not used to withhold legally required action.
B8. Compliance information and audit. DrSolid makes available information necessary to demonstrate compliance and allows and contributes to audits, including inspections, to the extent required by the applicable processing law. The parties use relevant records or independent assurance first where sufficient, and reasonable notice, confidentiality, security and proportionate scope for further review. An audit does not grant unrelated customer data, general proprietary source access or unrestricted security testing. Those safeguards must not obstruct a mandatory audit, regulator power or other required verification. Any additional commercial work or costs are agreed where lawful rather than presumed to override a mandatory obligation.
B9. Return and deletion. At the end of the instructed processing, DrSolid deletes or returns Customer Personal Data at the Customer's lawful choice and deletes existing copies, except where law requires retention. An available suitable return method may be used; a right to data does not include proprietary source code. Restricted backup handling and reapplication of deletion following restoration follow the Privacy Policy and applicable law. Independent legally justified records are distinguished from data held solely on the Customer's behalf. Required data-subject rights are not made conditional on settlement of an unrelated commercial dispute.
B10. International transfers. Transfers use the mechanisms and safeguards required by applicable law. Any required transfer clauses, parties, processing particulars and supplementary arrangements must be validly established for the actual transfer. The required transfer mechanism and particulars are established for the applicable relationship; a general customer authorization does not waive mandatory transfer protection.
B11. United States service-provider conditions. Where applicable law requires these restrictions for information processed as a service provider or contractor, DrSolid does not sell or share Customer Personal Data, use or disclose it outside the specified business purposes or direct business relationship, or combine it with another customer's or independently collected personal information except as that law permits. DrSolid provides the required level of privacy protection, notifies the Customer if it can no longer meet applicable obligations, and permits the reasonable compliance-verification and remediation steps required by law. The Customer may take required steps to stop and remedy unauthorized processing. These conditions apply to the covered processing; an independently determined use cannot be relabeled as service-provider processing to avoid them. DrSolid certifies its understanding of, and agreement to comply with, these restrictions where such certification is required.
B12. Priority and liability. This Appendix controls a conflict concerning processing it covers; mandatory transfer clauses and law control where required. The Terms' allocation of liability applies only to the extent it may lawfully apply to the relevant obligation or claim. No additional worldwide rights or service level are created merely by making legally required processing terms available.
